U.S. Supreme Court Blocks, Then Approves, Chrysler Sale to Fiat U.S. Supreme Court Justice Ruth Bader Ginsberg issued a temporary stay of Chrysler’s assets to Italian automaker Fiat, throwing a roadblock in the quick bankruptcy process that was hoped for. The sale of assets would have included Chrysler’s most valuable assets, such as plants, dealerships and contracts. The stay gave the Court additional time to consider objections raised by Indiana-based pension funds and other entities who felt they were being treated unfairly in the process – but the proposed sale was put in jeopardy by the delay. Upon further review, the Supreme Court affirmed the sale, which was promptly completed.

Federal Court Denies Cable Company Exclusive Rights

The Washington Court of Appeals held that a cable company can’t force all residents of a multi-unit apartment building to use its services if it wires the building. The decision upheld a Federal Communications Commission (FCC) decision that such exclusive provider agreements are anticompetitive. Banning exclusive agreements could help promote competition and reduce cable rates for an estimated 100 million consumers, FCC members said in interviews. The move will open the door for telephone giants Verizon and AT&T, which now offer video services, and smaller cable competitors such as RCN. Those companies have argued that long-term cable contracts lock them out of key markets.

President Obama Signs Legislation to Create Financial Fraud Commission

Legislation called the Fraud Enforcement and Recovery Act was approved by the U.S. House of Representatives, after being approved by the Senate. It will become law once it is signed by President Obama. The bill allocates $165 million over the next two years for increased enforcement activities against fraud related to mortgages, securities and commodities, financial institutions, and federal assistance and relief programs. The legislation would also create a “financial crisis inquiry commission,” consisting of ten members with subpoena power to investigate the cause of the current financial and economic crisis, as well as the collapse of major financial institutions.

Law and Legal Definitions

Dog Bites

Dog bite laws vary from state to state. The law of most states follows a “strict liability” theory. Under these statutes, the dog owner is responsible for any damage caused by an attack from their dog. In other states, in order for the owner of a dog to be liable to a person injured, the plaintiff must prove that the dog was vicious or had a natural inclination or tendency to be dangerous and that the owner had knowledge of such a tendency. Viciousness may typically be established by testimony regarding past attacks, past complaints, and methods of confinement.

More than 4.5 million people, including 2,000 mail carriers, are bitten by dogs each year, according to the Postal Service. It the official policy of the U.S. Postal Service to try to prevent dogs from biting their employees. However, the dog’s owner is held responsible if a dog bites or injures a postal carrier. Mail carriers are issued pepper spray to use if threatened by a dog. If they use the spray, they have to inform the dog’s owner. The owner can hold the carrier responsible if the dog is harmed by the spray.
