Appeals Court Rules Against FCC in ‘Net Neutrality’ Lawsuit
U.S. Court of Appeals for the District of Columbia Circuit ruled that the Federal Communications Commission does not have authority to require broadband providers to give equal treatment to all Internet traffic on their networks. The case involved an appeal by Comcast over an FCC sanction for interfering with high-bandwidth peer-to-peer traffic. The FCC sought to ban the company from blocking its broadband subscribers from using an online file-sharing technology known as BitTorrent. … (continue reading at the Reporter)
Lawyer Must Pay for Banning Service Animal from Law Firm
A lawyer who banned a service animal from accompanying a brain-damaged woman to a deposition will pay the woman a $40,000 settlement, as well as a $10,000 civil penalty. Attorney Patric LeHouillier of Colorado Springs will also train his staff on compliance with the Americans With Disabilities Act and post a sign at his law firm stating the service animals are welcome. The complainant, a veterinarian, had trained her Australian Shepherd to help her with balance, vision and hearing. The complaint alleged that LeHouillier refused to permit the dog in the firm because he was afraid it would soil the newly installed carpet. … (continue reading at the Reporter)
Wife Wins $9 Million from Husband’s Mistress
A woman in North Carolina sued her husband’s mistress for alienation of affections and the jury returned a verdict for $9 million against the mistress. The award was based on $5 million in compensatory damages and $4 million in punitive damages. Cynthia Shackelford, age 60, hired an investigator and discovered the affair. She decided to sue the mistress, Anne Lundquist, age 49, for breaking up her marriage of 33 years. Shackelford claimed that Lundquist pursued her husband, while knowing he was a married man. Lundquist claims the marriage was broken before the affair began. Alienation of affections is a legal claim that has been considered outdated and alienation of affections statutes have been repealed in the majority of states.
